Chatbots like Open-AI’s ChatGPT or Google’s Gemini and image generation tools such as Stability AI’s Stable Diffusion and the self-titled program from Midjourney are creating novel problems in IP as plaintiffs, defendants and the courts struggle to freshly apply old categories of copyright, trademark and patent law to these new technologies.
